General Disclaimer & Limitation of Liability

This document explains, in simple terms, the scope, limitations, and responsibilities associated with the Abdar Program (“Program”).

1. Nature of the Abdar Program

Abdar is a care coordination and facilitation program designed to support members through access to services related to healthcare, wellness, emergency assistance, insurance facilitation, and allied support services.

Abdar does not itself provide medical treatment, insurance, emergency response, or professional services, unless expressly stated in writing.

2. Role of Abdar

Abdar’s role is limited to:

  • Coordinating and facilitating access to third-party service providers
  • Providing information, reminders, and assistance in navigating services
  • Supporting members and sponsors with service coordination and escalation

Abdar does not:

  • Diagnose, treat, or medically advise members
  • Act as an insurer, healthcare provider, or emergency responder
  • Guarantee outcomes, timelines, or service quality of third-party providers
3. Healthcare & Wellness Services

All medical, diagnostic, wellness, nursing, home healthcare, and allied services are provided by independent third-party healthcare providers.

Medical decisions, treatment plans, prescriptions, and outcomes are the sole responsibility of the healthcare provider and the member.

Abdar shall not be responsible for:

  • Medical outcomes or complications
  • Accuracy of diagnosis or treatment
  • Delays, omissions, or errors by healthcare providers

Members are advised to seek independent medical advice where appropriate.

4. Emergency & Support Services

Emergency coordination (including ambulance support, hospital facilitation, or on-ground assistance) is provided on a best-effort basis.

Actual emergency response depends on:

  • Availability of local infrastructure
  • Response times of third-party service providers

Abdar does not guarantee response time, outcomes, or resolution in emergency situations.

5. Insurance-Related Services

Any insurance coverage offered under the Program is:

  • Provided by licensed insurance companies
  • Facilitated through licensed insurance brokers

Abdar is not an insurer and does not underwrite any risk.

Claim approval, rejection, payout amount, and timelines are determined solely by the insurer, as per policy terms.

In case of conflict, the insurance policy document shall prevail.

6. Third-Party Service Providers

Abdar works with multiple independent third-party vendors and service providers.

These providers operate under their own licenses, professional standards, and contractual obligations.

Abdar shall not be liable for:

  • Acts, omissions, negligence, or misconduct of third-party providers
  • Service quality, pricing changes, or availability
7. Digital Platform & Information

Information shared through the Abdar platform (dashboard, reports, notifications, messages) is intended for general assistance and coordination only.

While reasonable care is taken, Abdar does not warrant:

  • Accuracy, completeness, or timeliness of information
  • Continuous or uninterrupted platform availability
8. Limitation of Liability

To the maximum extent permitted by law, Abdar, its promoters, employees, partners, and affiliates shall not be liable for:

  • Personal injury, illness, or death
  • Medical, healthcare, or emergency outcomes
  • Financial losses, indirect or consequential damages
  • Service delays, failures or interruptions
  • Acts or omissions of third-party service providers

Any liability, if established, shall be limited to the fees paid for the relevant Abdar subscription period.

9. Member Responsibilities

Members and sponsors are responsible for:

  • Providing accurate and complete information
  • Following medical advice and service provider instructions
  • Complying with applicable laws and service terms
  • Timely communication during emergencies or service requests

Failure to do so may impact service delivery.

10. No Guarantee or Warranty

The Program is provided on a best-effort and facilitation basis.

No guarantees, warranties, or assurances—express or implied—are made regarding outcomes or results.

11. Changes to the Program

Abdar reserves the right to:

  • Modify services, features, partners, or terms
  • Update this disclaimer from time to time

Continued participation constitutes acceptance of such changes.

12. Governing Law & Jurisdiction

This document shall be governed by the laws of India.

Any disputes shall be subject to the exclusive jurisdiction of courts located in Kolkata.

13. Acknowledgement

By enrolling in or continuing with the Abdar Program, the member and/or sponsor confirms that they:

  • Have read and understood this Disclaimer
  • Accept the limitations and responsibilities described
  • Agree that third-party service terms and insurance policies prevail where applicable
